Pleading -- judgment on pleadings -- insufficient cause of action. 1. In an action brought under G.S. 1923 (2 Mason, 1927) § 9405, to set aside a judgment on the ground that it was obtained by the perjury and fraud of the prevailing parties, where the pleadings show that no trickery or fraud was used in invoking the jurisdiction of the proper court, that from the beginning both parties knew that there was but a single, well defined issue to be litigated, that the defeated parties had ample time to prepare for trial and were from the start represented by able attorneys, that the complaint charges no specific act or conduct tending to mislead the defeated parties as to the proof needed or steps to be taken in the trial, and that there is no charge of wrongdoing of the prevailing parties other than that of knowingly testifying falsely on the single issue tried of whether the deceased was the half brother of the prevailing parties or the uncle of the defeated parties, judgment on the pleadings is properly ordered, following Hass v. Billings, 42 Minn. 63, 43 N.W. 797.
